The “Open Borders” crowd is at it again — working to get federal judges to strike down a Texas law that protects Texans from invasion across our nation’s Southern Border.
The nonprofit organization I chair, America’s Future, is planning to be in court this Thursday to defend this Texas law, but I need your help.
Here’s what’s happening.
In 2023, Texas enacted SB 4 to protect its borders. That law makes it a state crime for noncitizens to enter Texas after they were denied admission into the country, or they were ordered to be removed from the country. And, if that foreigner commits a crime while in Texas, Texas state judges are authorized to have that foreigner thrown out of the country.
Naturally, the Biden Administration and immigrant groups challenged the law, and a pro-immigration federal district court judge issued an injunction.
When President Trump was sworn in as President in January 2025, the United States withdrew from the suit, but it continued. America’s Future filed a powerful amicus (“friend of the court”) brief in that case in support of the power of Texas to defend its border. We didn’t win completely, but the Fifth Circuit did dismiss that challenge, ruling the foreigners had no standing.
Then, only days after that suit was dismissed, another challenge was filed by other illegal aliens, from Honduras this time, again asking the same pro-immigration federal district court judge to enjoin the same Texas law. And that judge did it again, apparently believing that Texas has no right to protect its border. Now, that ruling is on appeal before the Fifth Circuit again, and this is where you come in.
America’s Future is one of the most active conservative organizations in the country in court, protecting our border. We are planning to file another brief this Thursday, but we need Texans to help us pay the lawyers working on this case.
Please don’t put this email aside and plan to respond later. We need your help today.
Do you agree with me that every state, especially border states like Texas, has the constitutional right to defend their borders from illegal invaders?
Do you agree with me that Texas has the right to act, especially when the federal government refuses to protect that border?
Do you agree with me that the Texas law, SB4, that empowers Texas courts to expel illegal aliens is an important and constitutional law?
If so, I need you to contribute $100, $250, $500, or more to help us file this brief and support our other important work.
And, if you are able to give $1,000 or more and would like to join us publicly, you can have your name listed on this brief as an amici. Someone from our team will reach out to you immediately to confirm how you would like your name to appear. Please contribute by Wednesday at 5 p.m. so we can include you in the brief.
There is not much time between now and Thursday, and I have already given the lawyers the green light to get working on this brief.
